– Geo-redundant storage across Madrid and Paris data centers

3.2 Data Processing and Security

All data is processed and stored within European Union jurisdictions (Madrid and Paris). ESGASY maintains full GDPR compliance with ISO 27001, 22301, 14001, 9001, and 50001 certifications. Our security infrastructure includes three-layer perimeter security with Firewall, IDS/IPS, and 2FA, utilizing enterprise-grade NVMe and NetApp all-flash arrays technology with WORM (Write Once, Read Many) data protection.

3.3 Service Availability and Compensation

In the event of service unavailability below guaranteed SLA levels:
– 95-99.99% availability: 10% monthly fee compensation
– 90-95% availability: 20% monthly fee compensation
– 85-90% availability: 30% monthly fee compensation
– Below 85% availability: 40% monthly fee compensation

4. WEB DEVELOPMENT AND E-COMMERCE SERVICES

4.1 Project Scope and Deliverables

ESGASY provides comprehensive web development services utilizing industry-leading platforms including Shopify, WordPress, and custom SaaS solutions. Our services encompass 3D modeling and UX design using Adobe Creative Suite and specialized tools, with standard project timelines averaging 2 months for delivery and project budgets ranging from €4,500 to €20,000 depending on complexity and specific requirements.

4.2 Client Responsibilities

Clients must provide clear project specifications and requirements, necessary content including images and branding materials, timely feedback during all development phases, and access to existing systems for integration purposes where applicable.

4.3 Revisions and Changes

Each project includes up to 3 major revision rounds per project phase. Additional changes beyond this scope will be quoted separately and require written approval. Any scope changes may affect both timeline and budget, and will be subject to new agreement terms.

5.1 Data Controller

Marketing data is retained until consent withdrawal or 3 years of inactivity. Security logs are retained for 12 months for incident investigation purposes.

5.5 Data Transfers

Primary processing occurs within the EU through our Madrid and Paris data centers. Third-party services utilize only EU-based providers with adequate GDPR safeguards. International transfers are conducted only with appropriate legal mechanisms including adequacy decisions and Standard Contractual Clauses.

Cloud service data remains the property of the client, with ESGASY acting solely as a data processor under GDPR requirements.

9. LEGAL ACTIONS, APPLICABLE LAW AND JURISDICTION

9.1 Applicable Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any legal action or proceeding arising under these Terms and Conditions will be brought exclusively in the courts of England and Wales, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

9.2 Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms and Conditions, the parties agree to first attempt to resolve such dispute through good faith negotiations. If such negotiations fail to resolve the dispute within thirty (30) days, the parties may pursue resolution through the appropriate courts of England and Wales.
